PET SALES CONTRACT/AGREEMENT

This Sales Contract/Agreement (“Agreement”) signed this ______ day of _________ 2004 by and between Linda and Floyd Wallace of Bordeauxcoon Maine Coon Cattery (hereafter “Breeder”), St. Charles, MO 63304, 636-244-2666, email address of bordeauxcoon@charter,net, and ___________________________________________(hereafter “Buyer whether singular or plural), whose mailing address and telephone number are as follows: _________________________________________________________________, and whose email address is _________________________________;for the purchase of a ___________________________________ Maine Coon kitten, (“_________________”), born on ____________________________ to GC, RW Coondavi KaineV of Bordeauxcoon (Sire) and CH Meowsh Limelight of Bordeauxcoon (Dam), (hereafter referred to as “Kitten”), for the total purchase price of _____________ ($_________), under the following terms, conditions and agreements”

1. Breeder guarantees that the above referenced Kitten is a purebred Maine Coon cat, and that the kittens litter is registered with the Cat Fanciers Association (CFA). An accurate copy of the Kitten’s pedigree is provided to Buyer at the time of delivery of said Kitten. As the above referenced Kitten is being sold as a “Pet”, registration papers on the aforementioned Kitten are being provided to Buyer at the time of delivery (if available from CFA), as long as the subject Kitten has been neutered/spayed at the time of delivery. If the registration slip has not been provided to Breeder by CFA at the time of delivery of said Kitten, then such registration will be mailed to Buyer within 5 weeks of delivery of said Kitten. If said Kitten is not neutered or spayed at the time of delivery, then the registration papers on said Kitten will be held by Breeder until such time as Buyer sends proof to Breeder that the Kitten has been neutered/spayed, all as set forth in paragraph three (3) below. It is then Buyer’s responsibility to register the individual Kitten with CFA, if Buyer so chooses.

2. Breeder guarantees the Kitten has been checked by a licensed veterinarian at least once since birth, that he or she has received at least two (2) upper respiratory Kitten vaccinations (as noted on health record) and has been wormed before leaving the cattery. It is the responsibility of Buyer to see that the Kitten receives any additional vaccinations for feline leukemia, rabies and annual booster shots for upper respiratory disease.

3. Buyer acknowledgers that the Kitten is not to be used for breeding, and has therefore been neutered or spayed before delivery to Buyer. If, under special circumstances, Kitten has not been spayed or neutered prior to delivery, Buyer agrees to have said Kitten spayed and /or neutered by a certified veterinarian by the age of six (6) months, with proof of said surgery being mailed to Breeder at the address above. Once Breeder has received confirmation of the spay/neuter, Buyer will be forwarded Kitten’s registration papers. Otherwise, as set forth above, registration papers are being delivered to Buyer at the time of delivery of said Kitten.

4. Breeder’s health guarantee covers viral/bacterial diseases, fungal infections, internal/external parasites and genetic anomalies. The written guarantee extends five (5) days from the above date of this contract. Breeder does guarantee that at the time of leaving the Breeder’s cattery, the above Kitten was considered to be in good health and of stable, affectionate temperament. However, for the protection of Buyer, the Kitten should be examined by Buyer’s veterinarian within five (5) days of delivery of said Kitten. If, within the guarantee period, Buyer’s veterinarian deems the Kitten to have one of the above listed conditions or diseases which veterinarian believes originated within the confines of Bordeauxcoon Cattery, Buyer has two (2) choices:

a. Buyer can return the Kitten within said 5-day period and request a full refund of the purchase, less a customary deposit; or

b. Buyer is to contact the Breeder at once, before any major treatment is begun (except in an emergency situation). If, during the veterinarian exam (within 5 days of receipt), a diagnosis of a disease or condition other than stress-induced minor upper respiratory infection or mild diarrhea is made, Breeder then agrees to pay fifty percent (50%) of any veterinary expenses up to a maximum of $100.00, to correct any medical condition or illness which originated from Bordeauxcoon Cattery, provided that Buyer’s licensed veterinarian summarizes the conditions of the Kitten, treatment required, and anticipated costs thereof, with sufficient evidence to document that the illness or condition was the responsibility of Breeder and originated within the cattery.

If the Kitten should die from a genetic defect during the first two (2) years of its life, as evidenced by a written autopsy report by a licensed veterinarian, Breeder agrees to replace the Kitten within a reasonable time determined by availability of kittens. The total liability of the breeder shall be in replacing the deceased/cat/kitten with a new Kitten, and Breeder will, in no way, be responsible for any vet bills incurred for treatment of said cat/kitten or to refund any monies paid by Buyer for said Kitten.

BUYER’S RESPONSIBILITIES:

Buyer agrees to have the Kitten examined by their veterinarian within five (5) days of purchase, and advise the Breeder of the results of the exam. Please be mindful that the stress induced in an animal when going to a new home may cause symptoms of illness, including diarrhea and minor upper respiratory infection, and may appear in an otherwise healthy animal.

Buyer agrees to accept full responsibility and care for the Kitten, by properly providing for its continued welfare, housing, proper diet, medical treatment and annual booster vaccinations. Buyer agrees that the Kitten will always receive prompt medical attention when necessary, and will never be allowed outside, unless leashed, harnessed or in a suitable carrier, and under complete supervision of Buyer.

Buyer also agrees that the Kitten will not, under any circumstances, be declawed.

Buyer agrees to provide Breeder with pictures of the Kitten at the age of one (1) year.

Buyer agrees to provide suitable companionship for the Kitten, never leaving it alone for extended periods of time without human interaction and attention. Buyer also agrees to provide generous amounts of “play time” and agrees not to cage the Kitten.

If, at any time in the future, Buyer determines that he or she is no longer able to keep the Kitten, Breeder shall be notified prior to Buyer surrendering said Kitten to any third party. Buyer also agrees never to sell, lease or give the Kitten to any pet shop, shelter or research facility. Breeder will be given first right of refusal to take said Kitten back, and there will be no monies refunded to Buyer if Buyer elects to give up ownership of said Kitten at any given time in the future.

If, at any time, Breeder is made aware that the Kitten is continually ill, malnourished, abused or neglected, or that Buyer has breached any condition of the Contract, then Buyer agrees to surrender the Kitten to Breeder, unconditionally, and Buyer thereby forfeits the right to a refund of the purchase price of the Kitten, unless the return of the Kitten is due to health problems within the first (5) days, as set forth in paragraph four (4) above.

Buyer needs to notify Breeder in the event the cat becomes lost, seriously ill, injured or deceased. Because this cat’s relatives have been used in a breeding program, any health problems discovered in this Kitten may have an impact on any kittens or cats related to the Kitten sold in this agreement. Should the cat suffer an untimely death, we may wish you to have an autopsy performed on said Kitten to determine cause of death and to provide copies of any professional opinions regarding any abnormalities found rendered in writing to us.

Buyer’s signature below indicates full understanding and agreement to ALL of the above-stated conditions.
